Wikimedia Foundation files amicus brief in NYT v. OpenAI, urging a split ruling on fair use
The Wikimedia Foundation filed an amicus brief in the consolidated OpenAI copyright litigation, which includes The New York Times' suit against OpenAI and Microsoft, and took neither side. It argues that training a general-purpose model on copyrighted work is likely fair use because the model is new and different from its sources, but that chatbots using retrieval-augmented generation to copy and reproduce articles should honor publishers' licenses, such as Wikipedia's CC BY-SA. Judge Sidney Stein has not ruled on fair use or on whether to accept the brief.
