Judge blocks Trump administration bid to dismiss NAACP pollution suit against Musk's xAI

A federal judge in Mississippi ruled that the Trump administration can join the NAACP's Clean Air Act lawsuit against Elon Musk's xAI but cannot use that role to get the case thrown out. The suit alleges xAI built and ran gas-fired turbines without permits in Southaven, Mississippi, to power its data center operations near Memphis. Chief Judge Debra Brown wrote that nothing in the Clean Air Act lets the EPA unilaterally dismiss a citizen suit, and gave the government until Oct. 23 to file a pleading setting out its position in the case.
